HONG KONG APPOINTMENT OF TWO PUISN JUDGES

In paragraph 4 of his minute of 9 June, Mr Rushford referred to the possibility of finding a suitable service candidate from outside Hong Kong and, particular, to the possibility of appointing Mr Justice Trainor.
2. I had my doubts about such an appointment, but my memory was at fault. I have consulted Mr Trainor's PROMS file and the Chief Justice of the Western Pacific's Reports indicate that he would be a suitable appointee.
3. Apart from his technical proficiency, the following other factors can be taken into account. Mr Trainor has been in the Western Pacific for ten years and a change is well overdue. Secondly, he is aged fifty-eight, which, taking into consideration the factors in paragraph 5 of Mr Rushford's minute, would be an advantage in preventing the High Court Bench in Hong Kong becoming stagnant for too long. Thirdly, I would have thought that Mr Trainor's claims to an appointment, if he wishes one, were greater than those of Mr Jackson-Lipkin, who has only been in Hong Kong for some three years or so. The latter could well wait a year or so until the next vacancies fall due.
