concerning appointments from the Bar to the

Bench from

(a) a number of District Judges and

Magistrates who are seeking assurances that such

appointments will not be made, or if they are,

that compensation will be paid,

and (b) Mr Litton on behalf of the Hong Kong

Bar Committee presenting the contra argument

that such appointments should be made.

Both the petitions will be forwarded to

us with the Governor's comments.

In view of these circumstances, the Attorney

General suggests that Mr Royle might reply to

Mr Tilney explaining that Mr Litton's original

letter has been overtaken by events as Mr Litton,

as Chairman of the Hong Kong Bar Association, has

submitted a petition to the Secretary of State on

the same subject, and that it would not now be

appropriate for the matter to be dealt with by

personal correspondence.

RECOMMENDATION

I recommend therefore that Mr Royle send a

reply to Mr Tilney on the lines of the attached

draft.
