Appointment of Judges of Appeal.

The Chief Justice of Hong Kong has put forward a proposal that two of the existing Supreme Court Judges should be renamed as Judges of Appeal and should normally sit in the Full Court, though they would also be available to try cases at the first instance in the Supreme Court.

The present proposal is therefore not to establish a separate Court of Appeal, but to give a more distinctive and permanent character to the Full Court, on which at present all Supreme Court Judges sit from time to time.

It would, I think, normally be the practice to appoint the two most senior of the Puisne Judges as Judges of Appeal, though it is not suggested that their salaries should be higher than those of the other Supreme Court Judges.

This seems to me to be a desirable development and I would be grateful to know if you see any objection to it. are agreeable, legislation will be prepared to amend the Supreme Court Ordinance as necessary.
