Explanatory Memorandum
Clause 2 amends section 2 of the principal
Ordinance. It transposes to the interpretation section
the definitions of "ordinarily resident", "disqualified
person", "exercises control in a company" formerly
enacted in sections 10 and 11, respectively, of the
principal Ordinance. Some changes have been made in
these definitions.

Clause 3 amends section 5 of the principal
Ordinance. Provision is made in this clause to increase
the number of members of the public sitting on the
Television Advisory Board from 2 to 3 and, consequentially,
to increase the quorum for a meeting of the Board from
3 to 4.

Clause 4 amends section 6(d) of the principal
Ordinance. This amendment requires the Television
Advisory Board to submit reports on the progress of
television broadcasting to the Governor at intervals
of not more than 18 months and provides that these reports
shall be tabled before the Legislative Council.
4.
Clause 5 repeals and replaces section 7 of the
principal Ordinance. The new clause specifies the
method of applications for licences to broadcast. Clause
6 amends section 8 of the principal Ordinance, which
relates to the granting of licences. It is intended to
clarify that where a licence to broadcast is granted
under the principal Ordinance the licensee is not
required to obtain separate licences under the
