(b) If agreement is not reached between Television

Broadcasts Limited and the second licensee on

the costs incurred by the former in establishing

any such facility the matter shall be determined

under the Arbitration Ordinance (Chapter 341).

(c) In the case of any facility established by

Television Broadcasts Limited the common use of

which is deemed by the Television Authority to

be essential, the process of determining the

amount payable by the second licensee to

Television Broadcasts Limited shall not delay

the second licensee in utilizing the

facility when it requires to do so in order to

permit it to proceed with the development of

the site :

Provided that the second licensee shall

take no action which will be detrimental

to the performance of the services being

operated by Television Broadcasts Limited.

(6) (a) On the issue of its licence the third]

licensee shall pay both Television Broadcasts

Limited and to the second licensee a sum

equal to one sixth of the costs of establishing

any facility referred to in subclause (5).
