HONG KONG AND THE GATT

1. As you may know, we have considered from time to time the position that would arise in connection with our relations with Hong Kong and the EEC under the GATT, if and when we joined the enlarged community. In the past, the discussions were not taken to any conclusions, largely because our negotiations with the EEC collapsed.

2. We must now of course clear our minds on what we should do after 1 January 1973. To this end we arranged an informal exchange of views between Mr Haddon-Cave when he was last in London and some of the experts from the DTI. A record of our discussion is attached. You will see from paragraph 11 that Miss Jean Elliott was kind enough to undertake the task of putting on paper the legal issues on which we all felt we needed advice. A copy of her letter to me of 15 May is also attached. For convenience I am also attaching the full text of Mr Steel's minute to me of 11 June 1970 (you will see from paragraph 10 of the attached record that I quoted from this minute at the meeting).

3. It would be most helpful if you could give us the benefit of your advice on the points set out in Miss Elliott's letter. If you think that a meeting would help, we are of course at your disposal.
