Attached is a copy of an Immigration Bill which was, so far as

we know, enacted by the Hong Kong Legislative Council on

1 September 1971.

The extent to which the Bill may have been amended in its

passage through the legislature will depend on the attitude

taken by the Governor in response to FCO telegram No 628 to

which we have not as yet received any reply. A copy of that

telegram is also attached.

Although the Bill has been the subject of examination in the

FCO over a period of several months, owing to a series of

oversights at this end, this examination culminated in a very

hasty preparation of a submission for the purpose of obtaining

Ministerial approval for the despatch of FCO telegram No 628.

A copy of the submission in likewise attached.

The submission was cleared in draft with Migration and Visa

Department and with West Indian Department. However, as a

result of further discussions with West Indian Department

since the submission received Ministerial approval, it appears

that the last sentence of paragraph 6 of the aubmission may

not correctly state the up to date position in regard to

Bermuda immigration legislation. However, there was no

reference to that legislation in FCO telegram No 628.
