As I mentioned to you, in the light of Ministers' conclusions on the Hong Kong Immigration Bill, Sir Leslie Monson wishes us to undertake a review of existing immigration legislation in the dependent territories. In carrying out this study, we should pay regard to the terms of the model immigration ordinance which the Colonial Office are understood to have prepared in the early 1930s and to have circulated to all territories by circular despatch in 1933 or 1934.

2. The study should consider whether in the light of Ministerial directions on the Hong Kong case (and possibly also in regard to the BVI and Bermuda - see para 6 of the submission) all territories should be invited to introduce amending legislation to provide for a judicial enquiry procedure in cases involving removal of illegal immigrants. As you will see, in the case of Hong Kong this has been thought essential if removal arrangements there arenot to become conspicuously out of line with the new deportation arrangements and safeguards applying in the UK.

3. Secondly, the study should at the same time consider whether after the lapse of 35 years there may not be a case for preparing a fresh model immigration ordinance for adoption by dependent territories.
