IMMIGRATION AND DEPORTATION LEGISLATION

1.

Graham Sneath wrote to me on 21 December (8/1250/70C) on the above subject. I am sorry that it should have taken so long to answer his letter.

2. The provisions of your draft Bill which we feel might cause Ministers some concern are contained in Clauses 15, 16, 17 and 55. I deal with these Clauses seriatim in the attached commentary. However, if Ministers are to be asked to agree to the inclusion in the Bill of provisions of this kind, they will wish to be informed beforehand in more detail of the reasons why it is considered that such powers are necessary. The explanatory memorandum accompanying the Bill is not very forthcoming on this point and we should be grateful for a more detailed explanation of the need for legislation in the form in which it is now drafted.

3. As regards the second paragraph of Sneath's letter, you will now have seen the summary of the contents of the draft United Kingdom Immigration Legislation which was sent under cover of a letter dated 7 January (GVM 6/2)

addressed to the Governor by the Head of Migration and Visa Department of the FCO (Brian Heddy).
