EXECUTIVE COUNCIL DECISION OF 29.6.71
The Council considered memorandum XCC(71)34.
The Council ADVISED and the Acting Governor ORDERED:
that, subject to the amendments detailed below, the Immigration and Deportation Bill 1971 be introduced into the Legislative Council :
(a) Clause 1 the short title should
be the Immigration Ordinance 1971;
(b) Clause 2 the definition of
-
'immigrant' should be amended to exclude any British subject who is the wife or child of a British subject born in Hong Kong or of a British subject by naturalisation in Hong Kong;
(c) Clause 52(2) the words 'For the
purposes of this Ordinance 'should be added at the beginning of the subclause.
The Acting Governor also ORDERED:
(a) that the power conferred by clause 32
be used sparingly in practice, and that the expenses continue to be met normally by Government;
(b) that when the Bill is enacted and
brought into force, consideration be given to the declaration of an amnesty for those illegal immigrants and overstayers who have been in Hong Kong for some time,
and who have not come to notice as undesirables.
