The purpose of the Ordinance (which

had the support both of the Chief Justice and of the

Director of Social Welfare) was to enable courts to c

combine the making of a probation order with a sentence

of caning in the case of persons of 16 years or over on

conviction for any offence scheduled in the Corporal

Punishment Ordinance (see paragraph 2 above).

4. Ministerial approval in this case was also

obtained for the enactment of the Ordinance.

(a) that by the Criminal Procedure (Amendment)

Ordinance, enacted in February 1971, the Hong

Kong Government have introduced on a trial basis

establish their first detention centre during the

"An Ordinance to amend the Corporal Punishment

Ordinance."

This Ordinance was passed by the Legislative Council on the

28th day of April 1971.

In accordance with clause XXVIII of the Royal

Instructions, an explanatory report by the Attorney General

showing the reasons and occasion for passing the Ordinance

is enclosed. Two copies of the Gazette Supplement containing

the Ordinance are also enclosed, together with a copy of the

Bill.
