This was discussed with the Secretary of State and Mr Royle yesterday. The previous submission and the exchange of telegrams with the Governor are attached.
2. Under the law as it now stands where any male person sixteen or over is convicted by a Court of any specified offence the Court may in addition to or in lieu of any other punishment for such offence sentence the offender to be caned. The specified offences (not in legal language) are as follows

Being in possession or control of arms or ammunition without a licence;
2. Robbery;

Shooting, wounding or striking with intent to do grievous bodily harm. Attempting to choke, strangle etc in order to commit indictable offence. Common assault. Stealing children under fourteen years old.
Any offence involving the larceny of any chattel, money, or valuable security from the person of any woman or child.
Piracy;
Rape or attempted rape of a girl under the age of sixteen years.
Carnal knowledge, or attempt at, of girl under sixteen years of age;
Indecent assault of girl under sixteen years of age.
The Hong Kong Government wish to add the following offences to this list

Possession of an offensive weapon in a public place. Affray (ie fighting by two or more persons to the terror of HM subjects).
A new item 2. in place of "Robbery" enabling a Court to order a person convicted of the offences of robbery, assault with intent to rob or aggravated burglary, to be caned.
