It is suggested that paragraphs 3 and 4 of Mr. Kinnear's draft should be amended as follows:-

"3.

As a result of the representations received, you will be glad to know that offences against "public order" will not be included among those offences which debar persons from holding union office for a period of five years and that the clause adding "obstruction" to the picketing law has been deleted. After very careful consideration, however, it is still felt that picketing of private residences should not be permitted though this amendment will not restrict the right to

picket a building which is both a residence and a place of work.

4. When the Bill is published you will see that a number of other changes have also been made which I hope you will agree represent improvements to the original draft. "

As you know Mr. Royle promised a reply in writing to the comments on the Trade Union Registration Bill handed to him by Mr Peter C K Chan. Mr Royle's views should be sent to Mr Chan through the Hong Kong Government and not direct. We should, therefore, have the draft of a letter for Mr Chan which could be signed by the Colonial Secretary, the draft making it quite clear that the views were coming from Mr Royle..

2. I had hoped that Mr Hurst would pick up the points raised by Mr Chan which were not dealt with in your original draft - for example, those in his paragraphs 2 and 4. He has not done so. I should, therefore, be grateful if you would re-draft, if necessary consulting Mr Hurst again and also the Legal Advisers.
