MEMORANDUM FOR EXECUTIVE COUNCIL

MERCHANT SHIPPING (AMENDMENT) BILL 1970

At Annex A for the consideration of Honourable Members is the Merchant Shipping (Amendment) Bill 1970.

The bill seeks to amend the Merchant Shipping Ordinance in three respects, namely:

to enable holders of the local certificate of competency (limited) for trawling masters to command trawlers of any size

Section 92 of the principal Ordinance imposes restrictions on the area of operation of trawlers

by their size and the competency of trawling masters. Thus a holder of the local certificate of competency as Trawling Master endorsed with the word "limited" may only command trawlers not exceeding one hundred and twenty feet in registered length within the area bounded on the North by the parallel of 25 degrees North and on the South by the parallel of 15 degrees South and on the East by the meridian of 122 degrees East (this area is shown in the sketch at Annex B). Holders of certificates of competency not so endorsed are also confined to the above area if the registered length of the trawler is below one hundred and twenty feet.

Changing conditions in the fishing industry and the advent of modern aids aboard trawlers have now made a restriction by trawler size unnecessary though it is still considered necessary to retain the geographical limitation in the case of trawlers commanded by trawling masters holding the local certificate of competency (limited), whose navigational skills are not of a standard adequate for safe navigation outside the specified area. The new section 92 accordingly removes the restriction by size of trawler but retains the limits beyond which a trawler may not be taken by a trawling master whose certificate of competency is endorsed with the word "limited. "

Clause 3 introduces amendments to section 93 consequential upon the revision of section 92.
