Detention
pending removal or
25.
(1) A person who is to be removed from Hong Kong
under section 15 may
deportation.
(a) be detained under the authority of an immigration
officer until he is so removed; and
(b)
if he is on board a ship or aircraft, be removed
therefrom under the like authority for detention
under this subsection.
(2)
A person may be detained under the authority of the
Colonial Secretary pending consideration by the Governor of
an application for the making of a removal order in respect
of that person.
(3)
A person in respect of whom a removal order or a
deportation order is in force may be detained under the
authority of the Colonial Secretary until he is removed
from Hong Kong under section 19.
Detention of
persons on board ships or aircraft.
26. (1) The master of a ship or commander of the
aircraft shall, if so required by an immigration officer or
police officer, take such steps as may be necessary for
preventing -
(a)
a person who arrived in the ship or aircraft and
has been refused permission to land in Hong Kong; or
(b)
a person placed on board the ship or aircraft
under subsection (2) of section 18 or subsection (3)
of section 19,
from landing from the ship or aircraft before it leaves
Hong Kong.
