29 -
(2) In the event of a contravention without reason-
able excuse of a requirement made under subsection (1) of
section 6 or of subsection (1), (2) or (3) of section 12 –
(a) the master of the ship or commander of the air-
craft, as the case may be; and
(b) the owner of the ship or aircraft and his agent,
shall be guilty of an offence.
39. Any person who is guilty of an offence under this
Ordinance for which no penalty is provided shall be liable
on conviction to a fine of five thousand dollars.
Continuance of certain
offences.
40. (1) where a person is convicted of an offence
under subsection (1) of section 38 consisting of a contra-
vention of subsection (1) of section 13 or subsection (1)
of section 14 and the contravention continues after the
conviction, then, unless he has a reasonable excuse for
the continuance of the contravention, he shall be guilty of
a further offence under subsection (1) of section 38 and
shall be liable on conviction to be punished accordingly.
(2) Where a person is convicted of an offence under
subsection (3) of section 38 consisting of a contravention
of subsection (1) or (2) of section 12 and the contravention
continues after conviétion, then, unless he has a reason-
able excuse for the continuance of the contravention, he
shall be guilty of a further offence under subsection (3)
of section 38 and shall be liable on conviction to be
punished accordingly.
