rights under their licence would not be

in any way affected by copyright legislation.

This assurance was not given and, as

stated in paragraph 11 above, the current

copyright proposals would, in fact,

diminish the company's rights under their

licence.

20. TVB's Attitude:

TVB do not accept

that the licence, in the absence of any

specific mention of aerial distribution

systems, confers an exclusive right to

operate such systems. In representations

to the Hong Kong Government they have put

forward the following additional arguments:

(1) aerial distribution systems (CATV and

ADS) for wireless television broad-

casts should not be the subject of

monopoly by any one company,

particularly if that company operates

a competing television service which

requires no aerials at all and if its

commercial interests are opposed to

the expansion of wireless television

broadcasting. The sole object of

such systems is to enable the public

to obtain good reception of television

programmes broadcast over the air and

such systems are quite separate and

distinct from wired television

broadcast services such as that

operated by RTV:
