(3) The Company has invested £3.6 million in Hong Kong and has irrevocable current capital commitments of

nearly £700,000; it introduced television to the Colony twelve years ago and incurred substantial losses during the establishment of the service. (4) Any arbitrary abrogation of or derogation from their

exclusive relay rights would occasion most substan- tial damage and would render it impossible for them to proceed with certain capital works involving sub- stantial outlay.

(5) In planning its wired television operations RTV has

placed complete reliance upon the exclusive rights

under its licence:

"indeed RTV may never have entered

into the television field at all had it not had those

rights"

(6) Since their licence was granted to the Company in

1957 there has, until recently, been no other station in existence in the Colony, the television broadcasts of which could have been received and relayed by them; that in the absence of any such station they have had,

perforce, to originate their own wired programmes. With the advent of TVB wireless broadcast television programmes in November, 1967, they had intended to begin exercising their exclusive rights by relaying TVB's broadcasts to their (RTV's) subscribers. They are accordingly protesting against the intention of the Hong Kong Government to prevent them from enjoying those rights at the very time when it first becomes

possible for them to do so.

(7) The appearance of a second television company, broad-

casting by radio, introduces strong competition; they accordingly object to the exercise of their rights under their licence being subjected to the control of their competitor.

(8) When their exclusive licence was granted, there was

not in existence any station, the broadcasts of which could have been received and relayed by them. Their exclusive right to do this was therefore clearly
