Hong Kong Judicial Posts and Appointments

We note from your despatches nos. 157 and 158

of 4 February that Bills including provisions referring

to a new post of Appeal Judge were published but that

when the Bills became Ordinances these provisions

were amitted. We should be interested to know what

you have in mind in respect of the creation of a new

post of Appeal Judge and who you think would be the

best local candidates for such a post were it to be

breated in the near future.

2. We also note from your despatch, reference

1/1749/53 II, of 5 February that you recommend the

appointment of Scholes as Senior Puisne Judge. We

doubt whether Scholes is a suitable candidate for

this post and he is certainly not the best local

candidate. It appears that you think that he would

hot be suitable to act as Chief Justice for any

length of time and we agree with this view. Thus, to

appoint him S.P.J. would raise false expectations

about acting as C.J. that could lead only to general

embarrassment. We have for some time been thinking

that the post of S.P.J. Berves no useful purpose

and is indeed an encumbrance, since' holding the post

to some holdnes
