On 20th March 1970 you sent me two letters, on the subject of an Appeal Judge, and on the more pressing matter of the post of Senior Puisne Judge - one of which was for myself and one which was designed so that it could be shown to the Chief Justice.

I have discussed the second letter with the Chief Justice and enclose a reply which is based on information provided by Sir Ivo Rigby. But I should perhaps make it clear that I do agree with the Chief Justice's views, and that I

personally think that it would be most difficult at the present juncture to substitute Blair-Kerr for Scholes.

I think a new factor which has entered into these discussions the premature retirement of Scholes does make it easier for you to accept the original recommendation in my despatch AKK14/4 No. 157 of 4th February. I hope so, anyway:

to appoint Scholes now would be rather too upsetting, I think, for the whole Judiciary when the appoint- ment is one of importance only for a matter of six weeks or so (although I am sorry to trot out this argument again!).
