PREVENTION OF BRIBERY BILL 1970
Significance Of Some Key Clauses
The term "public servant" in the Prevention of Bribery Bill 1970
includes, in wide terms, not only government servants, but also members
of the Executive, Legislative and Urban couriils, and employees of semi-
public bodies such as the utility companies.
Mr. D.T.E. Roberts, Attorney General, told the Legislative Council
on Wednesday anyone who offered an advantage to any of those persons was
offering an advantage to a public servant, and in consequence, committed
the offence of bribery.
He drew attention to the definition of "director" in the Bill,
because it reflected the Government's decision that the responsibility for
combatting corruption should remain with the Director of the Anti-Corruption
Branch of the Royal Hong Kong Police Force, and not be given to a new
organisation, independent of the Police force.
He dwelt at length on the significance of some of the key claus es
when he rose to move the Bill's second reading, making clear, for example,
how Clause 3 would affect the social life of "Crown servants," or people
who held a paid office under the Hong Kong Government.
