Below this minute is a note of the Legal Objections to Clause 10. The note is based on the part, concerning clause 10,of the memorandum which was an enclosure to (3).

2. You will notice that I have quite substantially extended the legal objections which are set out in that memorandum.

3. I am passing these papers through Mr. Rushford in case he wishes to amend or add to the note.

I have made two small changes.

It seems to me that paragraphs 4 and 5 of (10) ought not to be let pass without comment. They border on the impertinent and I think the Governor should be told firmly (?perhaps in a separate communication) that extraordinary measures of this kind, which are unlikely to be approved by H.M.G., ought to be referred back for comment before they are published locally. I find it astonishing that the Attorney-General lent himself to the publication

of a bill of this kind, even if the Governor and other officials in Hong Kong were too ignorant to realise the implications of the measures proposed.
