EXECUTIVE COUNCIL DECISION OF 10.11.70
The Council considered memorandum XCR (70)345.
The Council ADVISED and the Acting Governor ORDERED:
HICK 1419.
(a) that subject to the amendments detailed
below the Criminal Procedure (Amendment)
Bill 1971 be introduced into the Legislative Council
(1)
that the provisions dealing with suspended sentences of imprisonment be made operative for a trial period of 3 years, unless this period is extended by resolution of the Legislative Council;
(ii) that the words "greater or" be added
before the word "lasser" in the proposed new section 109C(i)(b);
(iii) that a provision be added to the Bill
to empower a court to attach to a suspended sentence much conditions as it thinks fit, any breach of them making the offender liable to be dealt
with in the same way as if he had committed a further offence;
(b) that the Nagistrates (Amendment) Bill 1971
be introduced into the Legislative Council.
