(3) Goods deposited in Community customs territory under the temporary import for processing scheme as well as the products obtained under that scheme may be brought into and remain in free zones only if they are taken over by the competent authorities to ensure that undertakings given pursuant to that scheme are complied with.
Article 3
Goods deposited in free zones must be capable of being the subject, under conditions determined by the competent authorities, of:-
(a) loading, unloading, transhipment or storage;
(b) the usual handling referred to in Article 9 (1) of
the Council's Directive (3) of 4 March 1969, on harmonisation of the provisions imposed by law, regulation and administrative action relating to the customs warehouses scheme;
(c) destruction.
Article 4
(1) Where goods deposited in a free zone do not fulfil the conditions laid down by Articles 9 and 10 of the Treaty, they
may not be put on the market or used under conditions other than those applicable in other parts of the territory of the Member State where the zone in question is situated.
(2) Goods referred to in paragraph 1 may be subjected in free zones to treatment other than the usual handling referred to in Article 3 (b) only under the conditions of and in accordance with the rules in force relating to temporary import for processing.
Member States may, however, insofar as is necessary to take into account conditions of customs procedure and supervision of the free zones, adjust the methods of control prescribed in this respect.
(3) By way of derogation from the provisions of the first paragraph of Article 4 (2) of this Directive, such processing undertaken in the territory of the Old Free Port of Hamburg shall not be subject to conditions of an economic nature.
Nevertheless, if in any specific economic centre of
activity competitive conditions within the Community are affected as a result of such derogation, the Council, acting in accordance with the procedure laid down in Article 100 of the Treaty,
shall adopt, in the corresponding economic centre of activity set up in the territory of the Old Free Port of Hamburg the conditions
of an economic nature laid down for the Community with regard to temporary import for processing.
