afraid (if you accept my recommendation) I shall just have to tell Fung (who is abroad and out of quick contact) that the Secretary of State does not propose to re-appoint him: and bear the results of his disappointment. He has been, I may add, a protege of Sir Sik-nin Chau's so we may get some reactions from the latter's circle.

Before proceeding to suggest new names, however, to replace Tse, Watson and H.C. Fung I would like to make one general point. The normal period of appointment prior to re-appointment in Executive Council is 5 years (Royal Instructions Clause II), and in Legislative Council it is 4 years (Clause XVI). Although these periods are maxima, nevertheless the extent to which we have re-appointed members should I think also be looked at with these periods in view. On this basis only Sir Albert Rodrigues in Executive Council and Y.K. Kan in Legislative Council have completed more than two 'normal' terms of appointment, and in both cases they have been specially valuable members. Also there has been perhaps a greater degree of turnover in Legislative Council than may be realised. Of those sitting in April 1964, when I arrived, only Y.K. Kan now survives: and of the expanded Council appointed on my recommendation on 1st July 1964 only two Y.K. Kan, and Woo will survive if these

- recommendations are accepted.
