(3) If, during or after any investigation, the Commissioner is of
opinion that there is evidence of any breach of duty or misconduct on the part of any officer of any department, he shall refer the matter to the Colonial Secretary.
22. (1) If in any case to which this section applies the Commis- sioner is of opinion
(a)
-
that the matter should be referred to the head of department
affected for further consideration;
(b) that an omission should be rectified;
(c)
that the decision should be cancelled or varied;
(d)
that any practice on which the decision was based should be
altered;
(e)
that any law on which the decision was based should be
reconsidered;
(f)
that reasons should have been given for the decision; or
(g) that any other steps should be taken,
the Commissioner shall report his opinion, and his reasons therefor, to the Governor and may nake such recommendations as he thinks fit. The Commissioner shall also send a copy of his report and recommendations to the head of department affected.
(2) The Colonial Secretary shall, within a reasonable time after the Commissioner's report and recommendations have been forwarded to the Governor under subsection (1)
(a) forward a summary thereof prepared by the Commissioner to the
Legislative Council, accompanied by such further report as the
