his office as Commissioner, or engage in any occupation for reward outside
the duties of his office.
Filling of temporary
vacancy.

Oath to be

5. (1) If the Commissioner
(a) dies;
(b) resigns;
(c)
is suspended or removed from office;
(d) is absent from Hong Kong; or
(e) is for any other reason unable to perform the functions of his
office,
those functions shall be assumed and performed by such person as may be
appointed to act as Commissioner by the Governor, by writing under his
hand, until such time as the Commissioner resumes the functions of his
office or a new Commissioner is appointed under section 3.
(2) A person may be appointed to act as Commissioner under subsec-
tion (1) notwithstanding that he does not comply with the provisions of
section 4.
6. (1) The Commissioner shall hold office on such terms and condi-
tions as shall, subject to the provisions of this Ordinance, be determined
by the Governor.
(2) Any salary or other benefit payable by virtue of this section
shall be charged on and issued out of the general revenue.
7. (1)
Before entering upon the exercise of the duties of his
Commissioner. office the Commissioner shall take an oath that he will faithfully and
impartially perform the duties of his office, and that he will not,
except in accordance with the provisions of this Ordinance, divulge any
information received by him under this Ordinance.
