Hong Kong: draft Commissioner for Administration Bill
Before a legal adviser examines the Bill, perhaps you would say whether your department has any policy comments, queries or doubts concerning the present text, which is, according to the comparative table, modelled on the New Zealand Act of 1962. In commenting on the Bill, perhaps your department would indicate, and give your views on, any significant departure from the New Zealand Act.
2. t would also be useful for your department to find out whether, in preparing the text, the Hong Kong authorities looked at the Guyana precedent of 1966 to which you refer or at the Mauritius Constitutions of 1966 and 1968 on which the Fiji draft you mentioned was based.
3. If the Hong Kong people have not considered the Guyana and Mauritius precedents they ou ht to do so before the Bill is examined here in case they wish to modify the present text; and it would be also helpful if Hong Kong provided a Legal Report on the present or any revised text of the Bill (as required by Colonial Regulation 149) explaining the reasons for its various provisions where these are not obvious on the face of the draft and also indicating whether any particular provision of the Bill is expected to give rise to any difficulty in Hong Kong.
