penalty or disability incurred or apprehended or

from any action or proceedings of a disciplinary,

civil or criminal nature, whether or not already

instituted;

(e) the exercise or forbearance from the exercise of any

right or any power or duty; and

(f) any offer, undertaking or promise whether conditional

"agent" includes a public servant and any person employed by or

acting for another;

"bankers books" means

(a) any ledger, day book, cash book, account book or

other book whatsoever, and

(b) any computer records,

used in the ordinary business of a bank;

"child" includes a child who is illegitimate or adopted, a

foster child and a step-child;

"company books" means the annual return and balance sheets and

any ledger, day book, cash book, account book, bank book or
