that an appointment to the Bench direct from the Ber should not be made in circumstances in which it would constitute an injustice to the prospects of officers in the judicial and legal services and hance a legitimate cause for grievance. The weighing of these
two opposing aspects of the public interest must be a matter of judgment on each occasion that a vacancy arises, in the light of
the circumstances at the time,

It might be helpful if the Lord Chief Justice were to discuss this problem informally with Sir Michael Hogan during his forthcoming visit to Hong Kong, with a view to offering advice and guidance on any difficult points of principle or of practical detail that may seem to stand in the way of making an occasional appointment from
the Bar.
