Thank you for your letter of the 17th October, 1968, which was received in Hong Kong on the 28th November, 1968.

I note that you regarded our discussions on the

9th August, 1968, as being "purely exploratory.

I enclose a Note (Restricted) of a Meeting between the Bar Committee and Mr. J.C. McPetrie (as he then was) on Friday, 27th, and Monday, 30th December, 1964. You will notice from this Note that paragraphs 1-3 relate to some of the principle matters that we discussed on the 9th August, 1968.

You may agree with me, in the circumstances, that most, if not all, of the matters discussed were not "new". In fact, I think I am right in saying that the problems I raised with you are not unknown to the Common- wealth Office. I understand, for example, that Ceylon had, for many years, a system whereby 1/3 of its Superior Court judges were appointed from the practising Bar, and Sir James McPetrie on Page 2 of the Note makes reference to their being precedents in other territories for making appointments to the Supreme Court Bench from members of the practising Bar. Sir James went on to point out, however, that in those territories it was generally true to say that members of the practising Bar were also recruited more fully into the lower judicial posts (in the past few years
