Notice to Exporters: Series 4 No. 14/68

Export of Restrained Textile Manufactures to Canada: Swing Scheme for Transfers between Categories

As foreshadowed in paragraph 11 of Notice to

Exporters No. 10/68 and paragraph 5 of Notice to Exporters No. 12/68 in this series, it has been decided, on the advice of the Cotton Advisory Board, to operate a swing scheme for restrained textile manufactures to Canada during the current textile year. The scheme will be operated in two phases, Phase I beginning on 16th December, 1968, and Phase II beginning on 1st April, 1969.

The main features of Phase I of the scheme are as follows:-

(a) swing between different groups is not permitted;

(b) companies holding quota in any of the categories listed at Appendices I III may apply for swing increase up to the maximum percentages indicated;

(c) down swing into the basket from categories with

specific limits in the fabrics group is unlimited but swing up from the basket to these categories is not permitted;

(a)

a company which has obtained a swing increase in a category may subsequently swing quota out of that category and vice versa;

(e) yardage secured through a swing increase may not subsequently be swung into another category;

(f) quotas obtained through temporary transfers may

subsequently be increased or reduced under the swing arrangements. In the case of swing increase, however, this is permissible only where the applica- tion indicates the agreement of the original transferor; and where such rights have not already been exercised by the quota holder prior to the transfer.

(g) the yardage required to permit swing into a category

may be obtained from the following sources:-

(1) unused balance of quota held by the applicants;

(ii) unused quota held by other quota holders provided there is mutual agreement to make this available.
