Extension of Merchant shipping (Loadline) Act
1967 to Hong Kong
Enclosed are four copies of a first draft of the Merchant Shipping (Loadlines) (Hong Kong) Order 1969. The following are the comments of the Board of Trade on the draft legislation enclosed with your saving despatch under reference:
"(1) Section 3 fourth item:- be to sub-section (4) not (3).
Clearly, the reference should
(2) Section 6:- Here and elsewhere it is proposed to delegate
a number of functions to the Director of Marine. We believe that
the appropriate person should be the Governor, despite the provisions of the Colony's suggested new section 35. Requests from other governments for the issue of a Certificate can only be made to the administration itself.

Section 11(2):- The re-drafting seems a little strange. Perhaps 'surveyor of ships" would be better than "Board of Trade Inspector". It is of course for you to decide on the acceptability of the wording.

Ditto as regards cancellations
"Power to make exemption" seems an unsatisfactory
side-note.
Comments in (2) above apply in regard to exemption. This is a matter which was regulated with some care in the Convention and which had been reserved entirely to the Board of Trade under the Act. It appears to be proposed that the Director should be the judge of exemptions and promulgate them by giving notice in the Government Gazette, or by a mere "direction".
