within 4 days of the Chief Justice requesting me to set out in writing my ideas on the indexing of the Reports. The subsequent course of events was as follows. On September 16th Mr. Haydon wrote to me requesting further and better particulars concerning my Memorandum.
I re- plied on September 20th. On October 18th I was called to meet Mr. Haydon who informed me he had authority "to negotiate." We discussed terms and he said he would ask the Crown Solicitor's office to draft an Agreement. I ex- pressed my concern at the delay in reaching a decision and with this in mind I myself drafted an Agreement and two days later, on the 20th, sent it to Mr. Haydon for his consi-- deration. He later sent me amended version containing terms which no intelligent person could have been expected to accept, but at a subsequent meeting with Mr. Haydon and Mr. Stevens all differences on terms were ironed out. Mean.. while on October 21st Mr. Haydon by telephone assured me that Government's decision would be given on Novem- ber 1st at the latest. On November 1st I was informed by Mr. Haydon that the project had been refused a place on the Finance Committee's agenda and a final decision would be made on November 14th. He indicated that since every- thing suggested the necessary money would be voted I might like to start work, though entirely at my own risk.
I agreed to do so and accordingly Mrs. R. G. Penlington started work on the Case Citator; she was to go on leave in mid- January, but yet wanted to do the job, she had no option but to start then: a later start would have given her no time to finish. As she was the ideal person to do the job a lawyer but able to work nearly full time, I di dnot discourage her. On November 14th Mr. Haydon informed me that the Finance Committee had deferred a decision until November 21st; on November 22nd he informed me that it had deferred a decision until the 29th. At no time was any explanation given for these postponements, despite the fact that Mr.
