In view of the delay I do not think that I could complete the indexing of the entire series in the time left to me. Accordingly, in the event of Government deigning to produce a decision on November 29th, I must tell you that the most I can now undertake to do is to index 1957-1964 (approx. 5486 pp) plus 1965-7 which will be about 2000 pp., I understand. If one can only do part of the job clearly it is more important to de the most recent stuff first.
If I get the above done and have time to spare I could then work back as time allowed. More than this I am no longer prepared to bind myself to do. I would expect payment on a scale pro rata to that already agreed for the full job.
The other Tables are not affected by the delay and I am prepared to undertake delivery of these on May 21st. It is only the complete subject- matter index which has been prejudiced.
The above extracts make it quite clear (1) that I was still prepared to bind myself to index about 7,500 pages (instead of the 11,600 I originally contemplated doing); (2) that I was still prepared to go back over the earlier volumes and index these if time allowed, though not to bind myself contractually to do so; and (3) that all the other items, such as the Tables of Cases and Statutes Judicially Considered, would still have been produced and delivered on the original schedule. Since I was still ready, therefore, to bind myself to have the bulk of the work done, and at least to attempt to complete the whole, I am at a loss to understand the inter- pretation which the Registrar appears to have chosen to put upon my letter.
