Deportation and Detention Regulations

There are no persons at present detained under the Emergency (Deportation and Detention) Regulations, providing for the detention of aliens pending their deportation.

Unsuccessful attempts have in the past been made to deport aliens held under the Principal Emergency Regulations, but China
has refused to accept them.
Review Procedure
5. A detained person can lodge objections against his detention to a Committee of Review immediately after the order is made and
thereafter at intervals of not less than two months. The
Committee's recommendations are not lightly disregarded.

Each case is carefully examined by the law officers before a detention order is made. The reasons for detention are given to the detainee. At the discretion of the Committee of Review, the detainee can present his objections through counsel, solicitor or other agent.
7. The case for continued detention is also reviewed from time to time by the authorities with a view to release as soon as possible having regard to the security considerations involved.
