Method of appointment
He should be appointed by the Secretary of State on the re- commendation of the Governor who should be seen to take cognisance of a wide range of public opinion before he makes the recommendation.
Term of Office
We recommend that the appointment should be for a fixed period of seven years in the first instance. When he has completed his term of office he should be eligible for reappointment but again the Governor should take into consideration public opinion. On completion of a full term of seven years he shall be entitled to an appropriate pension or gratuity without regard to the Pensions Ordinance, Cap. 89.
Removal
He may only be removed by the Secretary of State upon a re- solution passed by a two-third majority of the unofficial members of the Executive, Legislative and Urban Councils assembled together.
Salary
He should have the same salary and be entitled to the same entitlements as the Colonial Secretary and the Chief Justice for the time being.
Staff
We recommend in the particular circumstances of Hong Kong that the staff be adequate and include administrative assistants, legal assistants, investigators and an adequate clerical staff, completely independent of the Police and Legal Departments or any other department of Government.
Method of Finance
The Ombudsman and his staff should be financed independently of the general Hongkong budget. The finance should be determined by the Governor with the approval of the Secretary of State and should then be paid out of the Hongkong revenue.
