may disclose in any roport made by him under this Ordinance such matters as
in his opinion ought to be disclosed in order to establish grounds for his
conclusions and recommendations. The power conforrod by this subsection
shall not extend to any matter which might prejudico the security, defence,
or international relations of the Government of the United Kingdon or tho
Government of Hong Kong (including the relations of either Government with the Government of any other country or with any international organization)
or the investigation or dotection of offences, or which might involve tho
disclosure, without the consent of the Governor, of the deliberations of
the Executive Council.
Casos to
which section
21. (1) The provisions of section 22 shall apply in any case in
22 applies. which, aftor making an investigation, the Commissioner is of opinion that
the decision which was the subject-matter of the investigation
(a) appears to have been contrary to law; or
(b)
was unreasonable, unjust, oppressive or improperly discriminatory,
or was in accordance with a rule of law or a provision of any
law or a practice that is or may be unreasonable, unjust,
oppressive or improperly discriminatory; or
(c) was based wholly or partly on a mistake of law or fact; or
(a)
was wrong.
(2) The provisions of section 22 shall also apply in any case where the Commissioner is of opinion that in the taking of the decision a dis-
cretionary power has been exercised for en improper purpose or on irrelevant
considerations, or that, in the case of a docision made in the exercise of any discretionary power, reasons should havo been given for the docision.
(3) If, during or after any investigation, the Commissioner is of
opinion that there is evidence of any breach of duty or misconduct on the
