3. I AM ADVISED THAT IN THE UNITED KINGDOM NO STATUTORY OFFENCE IS PROVIDED FOR SUCH CASES. CONTROL OVER EMPLOYERS IS NO DOUBT EXERCISED BY STRONG AND EFFECTIVE TRADE UNIONS, WHICH IS NOT SO IN HONG KONG. LEGISLATION IN MANY FORMER COLONIAL TERRITORIES AND IN SOME FOREIGN COUNTRIES PROVIDES FOR PENAL SANCTIONS FOR NON-PAYMENT OF WAGES IN ACCORDANCE WITH ARTICLE 15(C) OF 1.L.0. CONVENTION NO. 95.

4. THE DRAFT EMPLOYMENT BILL IS ALMOST READY FOR PRESENTATION TO THE LEGISLATIVE COUNCIL AND I WOULD LIKE, IF POSSIBLE, FOR IT TO BE INTRODUCED AT THE NEXT MEETING ARRANGED FOR 21ST AUGUST. GRATEFUL TO KNOW URGENTLY IF YOU SEE ANY OBJECTIONS IN PRINCIPLE TO IMPOSING A PENAL SANCTION FOR NON-PAYMENT OF WAGES DUE WITHIN THE PRESCRIBED PERIOD HAVING REGARD TO THE SAFEGUARDS DESCRIBED IN PARAGRAPH 1.
