We refer to your letter dated 10th November, 1966, concerning the above-named Chinese Nationals.

We communicated the contents of your letter to the agents in Hong Kong, who signed the contracts on our behalf at the time of attestation by the Commissioner of Labour. We requested they bring to the attention of the Labour Department the unfair terms of the contract.

The reply we have received is far from satis-

factory.

(1) We pointed out that a person not choosing to

honour his contract could obtain better benefits than a person who was prepared to fulfil his contract morally as well as legally.

"May I suggest therefore that you request your agents to review their recruiting arrangements in an attempt to select more suitable workers"

Clauses 15, 17 and 19 of the contract refer to the Competent Authority and our agents pointed out that these were not enforceable by the Ministry of Labour.

"The only observation from the Ministryof Labour is that it cannot co-operate in enforcing the provisions of clauses 7(a), 14(c), 17 and 19 but has no objections for these remaining in the model contract"

We would point out that the Hong Kong Labour Department submitted a model contract, and in an accompanying letter informed us that we were invited
