With reference to you minute at (35), the two petitions have now gone to the Palace under cover of (37). While we are waiting for the reply, it might save time if we dealt with one or two outstanding points:

(1) The draft reply, behind (35), for the Minister to send to "Justice" contains two points on which I should be grateful for your further views. Paragraph 2 of the draft mentions the petition received from the Reform Club of Hong Kong. Unless you see particular objection, it would, I suggest, be preferable for the communications from the Reform Club and from "Justice" be kept in entirely separate compartments and that there should be no cross-referencing from one to the other. Paragraph 3 of the same draft promises Mr. Sargant a further letter in due course. Unless you consider that such a promise is necessary, it might be as well to try and avoid giving such an undertaking. To cover both of the above points, I attach behind this minute an alternative draft reply for the Minister to send to Mr. Sargant. Perhaps you would be good enough to say whether this alternative draft is suitable.

(2) The other draft behind this minute is a saving

despatch to the Governor. You will note that in this draft it is proposed that we should send the Governor copies of both the letters and the two memoranda received from "Justice" telling the Governor, at the same time, that we shall be getting in touch with him again as soon as we have completed a detailed study of the memoranda. Do you see any objection to this course? Or would you prefer that we should not send the memoranda to Hong Kong until you have completed your detailed study of them?

Notification of non-disallowance of the Ordinance will be sent under separate cover in the form of the usual printed despatch.

4. You will note that I am assuming throughout that the reply from the Palace will be an acceptance of the advice tendered to Her Majesty at (37).
