I think we should clear up this ambiguity. And I do think we should consider the point whether,
as
a matter of policy, there should be a differentiation between the case of F.S. Lee on the one hand in which the Hong Kong Government would bring the action, and on the other, the other two cases in which the officer concerned would start the proceedings. Is this differentiation in fact justified? Is it perhaps that in the case of F.S. Li it would apparently be an action for criminal libel whilst in the others it appears to be an action for libel.
