When I said that Sgt. Chu Leung could be deemed to have retired in the public interest I did not intend to imply that the record should be altered in this sense. What I meant was that the ex gratia and extra statutory pension should be awarded on the basis that Sgt. Chu Leung had been required to retire in the public interest. Unless some recognised basis of retirement is selected notionally for the purpose of calculating the award, the Hong Kong Government will not know how to give effect to the Secretary of State's wishes.

2. So I agree with the proposition that Sgt. Chu Leung should be given an ex gratia extra statutory pension as if he had been required to retire in the public interest on the date when his dismissal became effective.
