Mr. Jenkin's secretary spoke to me on the
'phone on this case in mid-January when I apologised for the delay and explained the great deal of work involved in reconstructing the papers and seeking legal and other opinions which a petition of this kind entails. I also underta to submit an interim reply to Mr. Jenkin, though owing to pressure of work on the Secretary of State's briefs and other matters calling for immediate attention, the latter has not proved possible.

There is an account of the case at Flag H on LEG.6606 attached which confirms that the facts of the case are those given in Chu Leung's letter at (2) though his language is exaggerated. He was dismissed from the Police in 1962 following disciplinary proceedings under the Police Force Ordinance on the grounds of disloyalty. In 1963 when it was proposed that he be deprived of his U.K. and Colonies citizenship (which he had acquired by naturalisation) he exercised his right to have his case referred to a Committee of Enquiry. The Committee's recommendation, which was accepted, was that the evidence of the Police enquiry was not sufficient to satisfy them that the defendant had shown himself to be disloyal and that he should not be deprived of his citizenship.
The Governor is satisfied that the decision of his citizenship does not provide sufficient grounds for interfering with the decision to dismiss him from the Police and I am inclined to accept his view. However, I do not think we can advise the Minister on her reply without obtaining a copy of the top secret despatch to which (7) refers and also the minutes of evidence of the original Police enquiry. I am arranging for this to be done and, in the meantime, submit a draft interim reply to
