THE ARCHITECTS ORDINANCE 1941

OF THE STRAITS SETTLEMENTS

SUMMARY OF THE ORDINANCE AND COMPLETE REGISTER

We have received a copy of the Architects Ordinance 1941 to provide for the registration of architects and to regulate qualifications of architects in the Straits Settlements. copy is on file in our office and is available for perusal by any of our readers at any time during business hours.

The Ordinance is in five parts with a copy of By-Laws made by the Board of Architects with the approval of the Governor in Council and the Scale of Fees approved by the Governor in Council with effect from the 1st November, 1932.

Part I covers the constitution and the proceedings of the Board of Architects......The Board shall consist of the following members:

The Director of Public Works The Director of Education

The Government Architect

The Municipal Architect, Singapore

Three practising architects of at least three years standing in the Colony to be nominated by the Governor anu one practising architect of at least three years stand- ing in the Colony to be nominated by the Council of the Institute of Architects of Malaya.

Without prejudice to the powers possessed by virtue of

Its incorporation the Board shall have the power-

(a) to hold or arrange for the holding of such examina- tions as the Board may deem necessary for the purpose of enabling persons to qualify locally for registration under paragraph (c) of subsection (1) of section & of Part II of this Ordinance.

(b) to fix from time to time subject to the approval of the Legislative Council the scale of fees to be charged by persons registered under Part II of this Ordinance for professional advice or services rendered or work done;

(c) to hear and determine disputes between persons

registered under Part II of this Ordinance;

(d) to appoint arbitrators for the purpose of hearing and determining disputes between persons registered under Part II of this Ordinance and other persons or firms; and

(e) to fix and regulate the etiquette of the architectural profession in the Colony according to the code of conduct as laid down by the Royal Institute of British Architects.

The Board shall keep the following registers:-

(a) Register No. 1: a register of architects qualified under

subsection (1) of section 6;

(b) Register No. 2: a register of persons holding engineer- ing qualifications as provided in subsection (2) of section 6;

(c) Register No. 3: a register of contracting companies and firms qualified for registration as provided in subsection (1) of section 9.

Part II sets out the qualifications of persons entitled to registration under this Ordinance. Those entitled to registra- tion in the register of architects are:-

(a) Any Fellow, Associate, or Licentiate of the Royal

Institute of British Architects,

(b) any person who shall satisfy the Board that he is

fully qualified by having received a

proper and recognised training in the profession of architecture;

(c) any person who shall pass such examination

examinations in architecture as may from time to time be prescribed by the Board; and

(d) any person whose name was on the register kept under the Architects Ordinance at the time of the coming into force of this Ordinance.

The conditions of registration of persons holding engineer- ing qualifications is also set out in this section. These quali- fications include the following:

THE FIRST SCHEDULE Section 6 (2) (a)

1. Corporate Member of the Institution of Civil Engineers. 2. Member or Associate Member of the Institution of

Structural Engineers.

3. Corporate Member of the Institution of Mechanical

Engineers.

4. Corporate Member of the Institution of Electrical

Engineers.

5. Building Surveyor Member of the Chartered Surveyors'

Institution.

6. Member or Associate Member of the Institution of

Municipal and County Engineers.

THE SECOND SCHEDULE

Section 6 (2) (b)

1. Bachelor of Engineering, or Bachelor of Science (Engineering) of any University in the United Kingdom of Great Britain and Northern Ireland or in any British Dominion or Colony.

2. Member of the Institution of Mining and Metallurgy. 3. Bachelor of Civil Engineering, Federal Polytechnical

Schools, Zurich, Switzerland.

4. Bachelor of Civil Engineering, Royal Technical College,

Copenhagen, Denmark.

Part III covers the registration of contracting companies and firms.

Part IV specifies the restrictions on unregistered persons and the penalty provided for fraudulent registration.

Part V is a general section providing for notification of change of address, certificate of registration and fees payable, application of fees and fines received under this Ordinance, removal of names from the register, appeal for refusal or cancellation of registration etc.

Paragraph 13 of the By-Laws, which covers the acts and practices on the part of an architect registered under this Ordinance which are prohibited and "shall be deemed to be conduct which is infamous in а professional respect," enumerates twenty-seven acts as unprofessional conduct,

The scale of fees fixed by the Board of Architects is, naturally a very comprehensively document covering all even- tualities and amongst other things provides for the following scales:

The above applies to all work, except repeat work such as shophouses, terrace houses or housing schemes where the same plans are applicable for more than one block or more than one building, in which case the fee for the first five houses shall be at scale rates, beyond that number the rate shall be reduced to 5% on the total cost of the remaining houses.
