28th September

Three Government employees at the Hok Un Government Quarry, Hunghom, were convicted by Mr. Blair-Kerr at Kow- loon yesterday on charges of larceny by public servant from the quarry of a large quantity of tarred and white stones, belonging to the Government. The accused were Kwok Loi, 43, fitter foreman, Chooi Wing-pun, 31, clerk, and Wong Hing- fun, 29, general office assistant, charged with stealing 10 and 6 cubic yards of tarred stones on July 5 and 11. respectively, and 7 cubic yards of white stones on July 12,

1st October

An appeal by Eu Tong Sen Limited against the decision of a Tenancy Tribunal in refusing an order for eviction of Shen Soong-tong from 5A Broom Road, ground floor, succeeded when Mr. Justice Gould remitted the case to the Tribunal for it to consider the evidence anew and make a fresh order bear- ing in mind the Judge's observations regarding the onus of proof in a civil case.

An appeal against the decision of the Chairman of a Tenancy Tribunal on the ground that he had no jurisdiction to make an order under section 17(c) of the Landlord and Tenant Ordinance, 1947, was dismissed by Mr. Justice Gould. Puisne Judge. in the Supreme Court yesterday. The order which was made by Mr. W. H. Latimer, Chairman of the Tri- bunal, was that the rent for the premises in use or possession of the respondent (ie. corner site of 179 Temple Street, ground floor) be reduced from $100 to $20 per month. This rental did not include the hire of showcases and or shelves.

5th October

An Ordinance further to amend the Landlord and Tenant Ordinance, 1947. will be given its first reading at the meeting of the Legislative Council this afternoon. It provides for the increase of the standard rent of business premises from 45 per cent. to 100 per cent.

7th October

There was brisk bidding at Souza's Auction Rooms, French Bank Building, when valuable leasehold properties in Kowloon were put up for sale. They were sections A and B of Kowloon Inland Lot No. 2095, together with buildings thereon known as 22 and 24 Mongkok Road. Bidding started at $40,000 and continued brisk until the property was finally sold for $68,000 to Mr. H. Lukyao, of the Lun Sang Building contractors, Holland House. The area of section. A is 1.012 square feet and that of section B. 968 square feet. The annual Crown rents are $13 and $12.30.

8th October

Existing 999-year leases-referred to in Sir Patrick Aber- crombie's Town Planning Report-are being converted into shorter leasehold terms, the "Sunday Herald" learned officially to-day. Issuance of Crown Leases for 999 years was dis- continued many years ago,

15th October

Delivering written judgment at Kowloon yesterday, Mr. Wicks ordered the closure of the whole of Nos. 149 and 151 Reclamation Street to be effective as from October 22. The judgment followed numerous hearings of an application for a closure order submitted by the Building Authority of the Public Works Department on the ground that by reason of certain defects the buildings were liable to become dangerous.

19th October

The Ordinance further to amend the Landlord and Tenant Ordinance, 1947, passed through its second and third readings in the Legislative Council. An amendment of an additional clause providing for the closure of buildings where there is real danger to the inmates or to passers-by, on the applica- tion of the Building Authority or a landlord, was approved. The Bill before Council permits an increase in the standard rent from 45 per cent to 100 per cent in the case of business premises.

21st October

A finding that the third opponents were not tenants of the premises but merely licensees and therefore not protected under the Landlord and Tenant Ordinance, 1947, was returned by Mr. W. H. Latimer, sitting as a Tenancy Tribunal, when he delivered his decision in an application for eviction brought by Messrs. Li and Fung, Ltd., of Marina House, against the occupants of 19 Connaught Road Central, first floor.

24th October

A report was issued to-day on the Sand Monopoly situa- tion. During the twelve months ended March 31 this year, 333,651 cubic yards of sand were sold by the Sand Monopoly for $3,062,174. The Report of the monopoly states that the demands for sand during the year reflected the Colony's immense build- ing programme, and although there were indications at the year's end that the peak of building activity had been passed, it was still considered necessary to acquire new areas for sand bins on both sides of the harbour in order to accumulate sufficient stocks to meet heavy demands should there be any delay in supplies reaching the depots.

28th October

Ejectment order against occupants of Causeway Bay flat was made to-day. Arguments advanced by Counsel for the Opponent that since money for payment of rent had always been advanced by his client to the person who was recognised by the landlord as the tenant of the flat there was a trust, either implied or resulting created, and that the recognised tenant was a trustee, were not accepted by Mr. W. H. Latimer, sitting as a Tenancy Tribunal, in granting an application for eviction of the occupants of 15 Dragon Terrace, first floor, Causeway Bay. The application was brought by a widow, Wong Yau-king, of 7 Dragon Terrace, first floor, against Wong Suk-Chun, a woman with an address at 8 Bay View Road, second floor, and Lau Nai-lam and all other occupiers of 15 Dragon Terrace. first floor.

30th October

Work on Hongkong's new airport on the shores of Deep Bay in the New Territories would commence as soon as the Hongkong Government has decided how they wanted it done, said Mr. David Rees-Williams, Parliamentary Under-Secretary of State for the Colonies, in a Press conference held yesterday evening. When a decision had been reached, the Air Ministry, which had offered to do the work, would send out a survey party to the Colony. An official of the Air Ministry of Works, in fact, was now in Hongkong to hold discussions with the Director of Public Works.
