A ruling on two preliminary points in connexion with the case in which the Sze Sun Barber Shop, of Tsa Ko Ling, New Territories, South, claimed damages amounting to $1,000 as the result of wrongful ojection by its landlord, Yau Kai, merchant, also of Tsa Ko, Ling, was given by Mr. Justice P. E. F. Cressall at the Summary Court yester- day.

Plaintiffs claimed that no notice to quit had been served on them and on June 20 were ejected from the premises with their families and their furnitures thrown into the street. They claimed $100 for special damages, $700 for actual damage of furniture, $300 for loss of business and $500 for exemplary damages on account of the high- handed and legal conduct of the defendant.
