REFUGE NOT PART OF A CROSSING"

WALKER LOSES ∙APPEAL

The Court of Appeal held that a refuge a controlled pedes-- trian crossing is not part of the crossing for the purposes of the trafic regulations.

The court dismissed the appeal of Mr. John Joseph Wilkinson, of Willington, Co. Durham. whose skull was fractured when he was knocked down by a car after he had stepped off a refuge at Artil- lery-row, 8.W. My, Justice Asquith had decided that he could not re- cover damages because of his con- tributory negligence.

The car was that of Miss Toro- thy Frances Chetham-Strode, of Greycoatgurdens, Westminster.

THE JUDGMENTS

Lord Justice Blesser, civ judgment, said that if the crossing was to be regarded as one con- tinuous crossing Miss Chetham- Strode would be liable because she failed to give Mr. Wilkinson "free and uninterrupted passage. But there was nothing in the sulations to prevent the conclu sion that there were here to be considered two, crossings.
