EVICTIONS ORDINANCE

AMENDMENT “ NOT IN THE GENERAL

INTEREST

Government's Intentions regard- ing the bill of an Ordinance to consolidate and amend the Pre- vention of Evictions Ordinances of 1938 and 1939, as drafted by a committee of two offic'al and five unoficial members of the Legisla tive Council, which was read a first time on September 1 and the second reading of which was not taken at the next meeting of "the" Council, formed the subject of a question asked by the Hon. Mr. M. K. Lo at yesterday a Council mest- ing.

GOVERNMENT'S REPLY

In reply to Mr. Lo, the "Colon'al Secretary, Mr. N. L. Smith, sa'd:-- Subsequently to the first reading of the Bil the Government came to the conclusion that some of its provisions, especially those which withdrew the protection of the 1938 Ordinance from certain classes of mortgaged premises. were contrary to the interests of the persons whom that Ordinance was ch'edy designed to protect.

Whi'e recognizing that the Ordinance pressed hardly mortgagees the Government considered that it was not In the general interest to amend the Ordinance to their part:en- lar advantage.

The decision which the Govern- ment came to does not involve the total abandonment of the B. which contained other provisions of a useful and helpful nature; but careful consideration of the effect of these provisions has had to be postponed while other legis- lative problems arising from the outbreak of war were being · dealt with.
