Evidence was given by Mrs. G. Simmons, of No. 40 Gloucester Road, that on September 15 she ordered a 5-lb. tin of Kim from Sincere's and paid $11.65, whereas at the end of July she paid $9.05 for the same goods.

Mr. Watson submitted that the prevailing market price on August 31 had not been been proved. Moreover, it was impossible to determine a prevailing retail price. The prosecution's evidence had even shown that the price charged by Lane, Crawford's was not ascer- tained.
